1General provisions
In short: By using the site you accept these terms.
These Terms of Use (the “Terms”) govern the relationship between the administration of the ANIMANIQ service (the “Service”, “we”) and the person using the site (the “user”, “you”).
The Service lets you create images with artificial intelligence, keep them in a private gallery and publish them in the public gallery and on an author page.
By using the site, including by confirming the open beta notice, you confirm that you have read the Terms and the Privacy Policy and accept them. If you do not agree with the Terms, please do not use the site.
The Service is not intended for persons under 16. Sections and sites of the Service with adult material are available only to adults — persons who have reached 18, or a later age if the law where they are sets adulthood later. Entering them requires age confirmation; by confirming it, you also confirm that viewing such material is lawful where you are.
2Open beta
In short: The site already works but is still being built — failures are possible.
The Service is in open beta and is provided “as is” and “as available”. Features, interface and terms may change; prices may change only for the future.
During testing there may be interruptions, delays, errors, and changes to or loss of user data and created images. We recommend saving the images that matter to you on your own device.
3Account
In short: The account is yours; signing in and everything done under it is your responsibility.
Generating, publishing and buying tokens require an account: an email address and a password. You undertake to provide a valid address and not to share access with third parties.
Actions taken under your account are considered taken by you until you inform us of unauthorised access.
We may restrict or disable an account if the Terms are breached, or when required by law.
You can ask to delete your account through the support chat. The account is disabled and the public author page is closed; records of payments and token movements are kept to the extent and for the periods required by law.
4Tokens and payment
In short: Tokens pay for generation; on failure they are returned automatically.
Tokens are the Service’s internal units of account. They pay for creating images; the cost of a generation is shown on the site before it starts.
When a generation starts, its cost is reserved. If the image was not created because of a technical failure, the reserved tokens return to the balance automatically. Token movements are shown in the history on the balance page.
Tokens are bought by transferring cryptocurrency (ETH) to the address and in the amount shown on the purchase page. Tokens are credited after the transfer is confirmed on the network. The sender pays the network fee. A transfer to a different address, on a different network or of a different amount may not be credited automatically — in that case contact support.
Transactions on the Ethereum network are public by the nature of the network and cannot be reversed.
Tokens are not money and cannot be exchanged for money or transferred to other users, unless applicable law expressly provides otherwise. A refund for purchased tokens is possible in the cases provided by law; requests go through the support chat.
Credited tokens keep their value when prices for future purchases change.
5Content rules
In short: No other people’s faces without consent, nothing illegal, nothing that harms people.
It is forbidden to create, upload or publish:
- images with the faces of real people without their explicit consent;
- sexual material involving minors or persons who look like minors — in any form, including drawn;
- material that breaks the law or promotes violence, hatred or discrimination, harassment or threats;
- images that present fiction as fact about real people or events and may mislead;
- material that infringes the rights of third parties, including copyright and related rights, trademark rights and the right to one’s image.
It is forbidden to bypass moderation, to automate access to the Service without our permission, or to create excessive load.
In case of a breach we may hide or delete the material, restrict publishing or disable the account. Tokens spent on material created in breach of the Terms are not returned.
6Faces and samples
In short: Your own face — yes; someone else’s — only with that person’s consent.
You can upload a photo of a face as a sample for your generations. You may upload only your own face or the face of a person who has given you explicit consent.
When a sample is uploaded we record your confirmation of consent. The sample is visible only to you and is used only for your generations.
You can delete a sample at any time: the file is deleted, and the record of the confirmed consent is kept as proof that it was given.
7Publishing and rights to images
In short: You decide what to publish; we show what is published on the site.
Created images are kept in your private gallery and are not visible to others until you publish them.
Published images are visible to everyone in the public gallery and on your author page — together with your name, avatar, cover and country flag, if a country is set.
By publishing an image you grant the Service a free, non-exclusive licence to store, reproduce and display it within the Service — including in reduced copies — for as long as it is published. By unpublishing it you stop its display; copies in caches may remain for a short time.
The Service claims no rights to your images. Whether AI-generated images are protected depends on the law of your country; you are responsible for any further use of the images.
8Moderation and reports
In short: We check publications and review reports.
Publications go through automatic and, where needed, manual review. We may reject a publication, or hide or delete an image that breaches the Terms.
Any user can report an image. Reports are reviewed; a decision can be challenged through the support chat.
9Liability
In short: We are liable within the law; your statutory rights are not limited.
To the extent permitted by applicable law, the Service administration is not liable for indirect losses, lost profits or loss of data arising from use of the Service, including during the open beta.
Images are created automatically and may not meet expectations. The user writes the prompts and is responsible for their content and for the use of the results, including respecting the rights of third parties.
Nothing in the Terms limits user rights that cannot be limited by law.
10Changes to the terms
In short: You will see and confirm a new version on the site.
We may change the Terms. The current version and its date are published on this page. A notice on the site announces a new version; by confirming it you accept the new version.
Changes do not affect tokens already credited or images published before they take effect, unless the law requires otherwise.
11Contact
In short: Write to the support chat — we will answer.
Questions about the Terms, complaints, requests to delete an account or for a refund — through the support chat on the “Help” page.
